Overview:
Building and sustaining a successful private practice requires more than clinical excellence. It also requires a clear understanding of the ethical, legal, and regulatory responsibilities that govern how mental health professionals establish, operate, and grow a practice. Whether you are considering private practice, maintaining a solo practice, or growing a group practice, integrating ethical and risk management principles into every business decision helps protect your clients, your license, and your long-term professional viability.
In this interactive six-hour webinar, psychotherapist, entrepreneur, and former group practice owner Joyce Marter, LCPC, CSP, shares practical strategies and lessons learned from nearly 30 years in the mental health field, including founding, growing, and ultimately selling a multi-state counseling practice with more than 100 clinicians.
Participants will explore the ethical and regulatory foundations of private practice, informed decision-making in fee-setting and insurance participation, ethical marketing and referral relationships, HIPAA and documentation standards, risk management in intake and billing, and the supervisory and legal responsibilities of moving from solo to group practice. The program will also address ethical considerations in hiring, supervision, and building a healthy workplace culture.
Throughout the program, participants will be encouraged to identify when specialized legal, accounting, insurance, technology, or other professional consultation is needed. Participants will leave with practical tools and an individualized action plan that integrates ethical, legal, and regulatory considerations into next steps for their practice.
Objectives:
Upon completion of this program, participants will be able to:
Identify ethical considerations (per APA, NASW, ACA, and NAADAC codes) involved in transitioning from employed clinician to private practice owner, including scope of practice, competence, and business-related dual relationships.
Describe the legal and regulatory requirements for establishing a mental health private practice, including business structure, HIPAA compliance, state licensure, and mandatory reporting obligations.
Apply ethical marketing and advertising standards consistent with professional codes of ethics when developing branding, website content, testimonials, and referral relationships.
Evaluate the ethical and clinical implications of fee-setting, sliding scales, insurance participation, and financial arrangements with clients.
Identify risk management practices for intake, informed consent, documentation, billing, and record retention that support ethical and legally defensible practice.
Differentiate the ethical, legal, and supervisory responsibilities of solo versus group practice ownership, including hiring, supervision, and vicarious liability.
Describe strategies for clinician self-care, boundary-setting, and burnout prevention as an ethical obligation to protect client welfare.
Develop an individualized action plan that integrates ethical, legal, and regulatory considerations into next steps for their practice.
